The case filed against the Federal Government and President Muhammadu Buhari over breach of the constitution and federal character principle in appointments has been stalled yet again over the failure of the federal government to enter its defence to the suit.
At the second day of hearing, counsel for Buhari, Tijani Gazali, told the court that the matter is not ripe for hearing, as he is not ready.
Tijani stated that the 30 days stipulated for him to file his response will expire on the 22nd of July, 2020, insisting that the defendants are still within time to react to processes served on them by the plaintiff.
The plaintiffs which include leader of the Pan Niger Delta Forum Edwin Clark and other leaders of Nigeria’s ethnic nationalities have argued that President Buhari has consistently flouted the Nigerian constitution in his appointments in favour of a section of the country
According yo them, key positions in the security sector of the country are headed by people from a particular ethnic group and religion especially from the northwest and northeast
The presiding judge, Justice Okon Abang urged the defendants to file and serve their processes before the next adjourned date.
He therefore adjourned the matter to 2nd October 2020 for hearing.
