Benue APC Crisis: Court Extends Interim Order On Ganduje Led NWC

The State High Court has extended the interim injunction restraining the APC from dissolving the Agada-led State Working Committee.

Agada initially secured the interim order on August 21, 2024, preventing the Ganduje-led National Working Committee from dissolving the State Working Committee until the expiration of its tenure.

Justice Theresa Igoche, who issued the injunction against the National Working Committee, adjourned the case to August 28, 2024, for a hearing on the motion ex parte.

During Wednesday’s hearing, APC counsel Yahaya D. Dangana who led a team of seven lawyers, including the State’s Attorney General, argued that the APC was within its rights to dissolve the State Working Committee and filed a notice of preliminary objection in court.

Dangana also contended that no further steps could be taken in the proceedings until the objection was addressed.
However, M.T. Alyebo, counsel for Agada and eight other applicants, refuted this claim, asserting that the filing of a preliminary objection did not prevent the court from exercising its authority to preserve the status quo.

Alyebo urged the court to extend the lifespan of the interim order, a request strongly opposed by Dangana.

In her ruling, Justice Theresa Igoche extended the interim order by an additional seven days. The judge clarified that the injunction was issued and served in the “morning,” while the committee’s dissolution occurred in the “evening.”
