A Federal High Court in Port Harcourt has struck out the case filed by the Peoples Democratic Party Governorship aspirant in Edo State Omoregie Ogbeide-Ihama seeking to stop Godwin Obaseki from contesting Thursday’s governorship primary of the PDP.
This followed an application by the counsel for the plaintiff Ferdinand Orbih to withdraw the case
The plaintiff had sought for an injunctive order restraining the PDP from allowing any aspirant except those who have purchased forms and were screened within the time earlier stated before the party announced a postponement of the primary to June 25.
The order was specifically targeted at stopping Godwin Obaseki who recently defected from the All Progressives Congress APC from being an aspirant for the candidacy of the PDP in September’s governorship election in Edo state.
Even though the PDP had granted Obaseki and his deputy Philip Shuaibu waivers to contest in the primary, the plaintiff argued that the decision negates the initial timetable for the purchase of forms and nomination issued by the party.

But at Wednesday’s hearing, the plaintiff Ihama-Ogbeide made a u-turn, informing the court that he wants the matter settled out of court.
The case was consequently stood down by the trial judge Emmanuel Obile to enable the parties confer among themselves on the terms of settlement.
After the resumption of proceedings three hours later, the plaintiff applied to withdraw the case. With none of the parties objecting, the judge consequently struck out the case
