Federal High Court sitting in Kano, presided over by Justice Abdullahi Liman, has restrained Kano State Government from taking N10 billion loan for the installation of CCTV cameras across the five Emirates in the state.
The restriction followed
a motion exparte filed by Kano First Forum (KFF), a Non government organization dated June 27 sworn by the Director General of the Association Dr. Yusuf Isyaka Rabiu.
KFF through their counsel Barrister Badamasi Suleiman Gandu, prayed the court to restrain the Governor of Kano State from taking the N10 billion loan.
The group is stopping the Governor of Kano State from taking the sum of N10 billion loan on the allegations of noncompliance with rules and regulations governing loan transactions
The applicants in their prayers alleged that the state government did not comply with Debt Management Office Establishment Act of 2003, Fiscal Responsibility Act 2007 and laws of Kano State 1968 praying the court to declare the Defendants action as illegal, null and void.
The respondents in the suit are the Governor of the State, Attorney General of Kano State, Commissioner of Finance Kano, Speaker Kano State House of Assembly.
Other respondents in the suit are Access Bank, Federal Ministry of Finance, Debt Management Office and Fiscal Responsibility Commission.
Justice Liman granted the prayers of KFF and restrained the first respondent from taking the N10 billion loan and ordered all parties to maintain status quo.
He also ordered the plaintiff to serve Federal Ministry of Finance, Debt Management Office and Fiscal Responsibility Commission with the order and other court processes.
The adjourned date will be communicated later to both parties in the suit.
