A Magistrate Court sitting in Warri, Warri-South Local Government Area of Delta State has adjourned hearing on the suit of the alleged missing crown of the Olu of Warri to April 20, 2022.
The suit was brought following a petition from the palace of the Olu of Warri against Chief Ayiri Emami, the Ologbotsere of Warri Kingdom.
Counsel to the applicant had on Monday urged the court to adjourn the case to enable the Investigating Police Officer IPO that was absent in court due to an official assignment, to appear on the next hearing date.
The IPO had in January opened the prosecution case which had suffered several adjournments.
At the resumed hearing on the prosecution case today, the Applicant/Claimant Counsel, Abiodun Amuda-Kannike (SAN) , told the court that the palace of Olu of Warri, petitioned the Chief Judge of the State for the transfer of the case from the Court on grounds of insecurity and alleged close relationship with the magistrate to the defendant, Chief Ayiri Emami.
In a counter motion, the lead defence Counsel, Otomiewo opposed the claims saying, the vicinity of the Court was best suitable for the case as it was surrounded by several security formations.
The court therefore, refused the application for transfer of the case to another court and also ruled out the petition that the court premises were secure for the case.
The Court subsequently adjourned the case to April 20 for further hearing.
