Plateau State High Court has in two separate applications granted bail to Noah Kekere and Two other alleged organ Harvesters in Jos.
The rulings on the two separate applications, came up Wednesday at the High Courts 9 and 11, Presided over by Justice D.G Fombing and Justice N.D Shashe’te.
The two Courts had separately, remanded in Jos Correctional Center, Noah Kekere, Philip Dachung and Yusuf Abdullahi, over an alleged kidney theft, criminal conspiracy and human organs trafficking of one Kehinde Kamaru and Ibrahim Ajibade, respectively.
However, defense counsel for the accused, Samuel Shaka, had in November, 2023, sought for their release on bail, a motion which was separately, opposed to by the Plateau State ministry of justice, led by Director of Public Prosecution, Williams David.
Coincidentally, the rulings on the two separate applications, came up Wednesday, and the two courts granted the applications, as sought.
Justice D.G Fombing, of Court 9, held that he was unable to find any of the five adverse circumstances provided under Section 177 of the Plateau state Administration of Criminal Justice law 2018 for the refusal of Bail in existence in the Application to warrant the refusal of Bail to the Defendants/Applicants.
According to Justice Fombing, the accused are admitted to Bail upon fulfilments of five conditions which are the sum of Twenty Million Naira with two Sureties in like sum each.
One of the Sureties to each Applicant shall either be his biological father or mother or brother or sister.
The other Surety of each Applicant shall be his Paramount Ruler who is a graded Chief on the pay roll of the Government, who shall provide the evidence of his appointment as such to the Court.
Also, Each Surety shall supply two copies of his or her recent self-passport photographs to the Court and the Defendants/Applicants shall deposit the Original copies of their International Passport with the Registrar of this Court.
Noah Kekere and Yusuf Abduallahi, were first granted bail at High Court 11 presided over by Justice ND. Shashe’te, pending determination of the substantive suit.
The matter was adjourned to 28 January, 2024 for hearing on the substantive suit.
