The Abuja Division of the Court of Appeal has dismissed the appeal filed by Sani Yahaya of the New Nigeria Peoples Party, NNPP, challenging the governorship election of Kefas Agbu of the Peoples Democratic Party, PDP, as governor of Taraba State.
Yahaya and his party had challenged the result of the March 18 Governorship Election on the grounds of non-compliance with the Electoral Act, saying that Agbu didn’t score the majority of lawful votes cast.
While delivering judgment, the appellate court held that the reliefs sought by the NNPP candidate were inconsistent, having faulted the outcome of the polls, on grounds of non-compliance with the Electoral Act, yet praying the court to declare him the winner of the same election.
The appellate court in a unanimous decision, dismissed the appeal of the NNPP for lacking merit, affirming the decision of the Taraba State Tribunal.

Governor Kefas Agbu had polled 257,926 votes to defeat Yahaya, who got 202,277 votes in the March 18 Governorship Election
Dissatisfied with the outcome of the election, the petitioners instituted a petition against the victory of the PDP and its candidate, Kefas Agbu, on the grounds of non-compliance to the provisions of the Electoral Act 2022.
