Court orders substituted service on Tinubu over alleged certificate forgery

The vacation judge of Federal High Court Abuja, Justice Ahmed Mohammed has fixed September 7, 2022 for hearing of the suit seeking disqualification of former Lagos State Governor, Bola Tinubu as 2023 Presidential candidate of the ruling All Progressives Congress, APC for allegedly forgery of certificate.

The Court fixed hearing, just as it granted an ex-parte order for substituted service on Tinubu who has invaded personal service of court processes.

The plaintiffs are praying the Court for
an order disqualifying Tinubu from contesting or participating in the 2023 Presidential election as the APC candidate for presenting a forged certificate to the Independent National Electoral Commission, INEC.

The plaintiffs who are four APC chieftains jointly instituted the action against INEC, their party, Bola Tinubu, National Assembly and the Attorney-General of Federation and Minister of Justice.

Plaintiff’s counsel, Goddy Uche SAN, told the vacation judge that the substituted service was necessary because all attempts to serve the third defendant have proved abortive as he cannot be reached.

In a brief ruling, Justice Mohammed ordered that the court process to be served on the APC National Secretariat and that such service shall be deemed as having been properly served on Tinubu and the party’s Presidential candidate.

The Plaintiffs claim that in order to conceal the falsity of the information, the APC presidential candidate, Bola Tinubu submitted to INEC, he had omitted and failed to provide any information whatsoever relating to his primary and secondary schools in his INEC form for the 2023 election.
