The Court of Appeal in Abuja is set to deliver Judgment in a total of nine appeals before it by both the Turaki-led Peoples Democratic Party, PDP, and the Wike-led faction over the judgments of the trial court stopping the November 15 and 16 national convention of the party held in Ibadan, the Oyo state capital.
The appeals filed by members of both factions of the PDP emanated from three judgements of the Federal High Court sitting in Abuja, delivered by Justice James Omotosho, Justice Peter Life and Justice Joyce Abdulmalik.
The appeal has the PDP, its National Working Committee (NWC) and National Executive Committee (NEC) as appellants while INEC, Austin Nwachukwu, Amah Abraham Nnanna, Turnah George, Senator Samuel Anyanwu, Umar Damagun, Ali Odefa and Emmanuel Ogidi are listed as respondents.
On the last adjourned date, Chris Uche, SAN, while adopting the appellants’ brief of arguments alongside other processes filed on behalf of the appellants, noted that the appeal is against the October 31,2025 judgement delivered by Justice James Omotosho.
The senior lawyer, in his submissions, said judgment was delivered out of jurisdiction by the court and urged the appellate court to set aside the judgment of Justice Omotosho and allow the appeal.
Counsel for the first to third respondents, Joseph Daudu, SAN, while adopting the notice of preliminary objections, briefs of argument, as well as the list of authorities on behalf of his clients, urged the court to grant the preliminary objections and dismiss the appeal.
Other respondents, also, in their various preliminary objections aligned themselves with Daudu’s submission, praying the court to dismiss the appeal for lacking in merit and for being an academic exercise.
