The All Progressives Grand Alliance, APGA, and its Governorship candidate in the March 18, 2023 Enugu State election, Frank Nweke Jr. have withdrawn the petition filed against Governor Peter Mbah challenging his declaration as winner of the poll.
Counsel to the Petitioners, Professor Race Achara at the Tribunal session, Sunday told the Court that his client wished to make an oral application to withdraw the petition.

Neither of the Counsel to the three respondents, INEC, Governor Peter Mbah and the PDP objected to oral application of the Petitioners.
In a short ruling, Chairman of the Tribunal, Justice M. K Akano struck out the petitions of APGA and Frank Nweke Jr.
In another development, the Labour Party and its Enugu State governorship candidate Chijioke Edeoga have closed their case against Governor Peter Mbah, PDP and INEC.
Counsel to the Petitioners, Valerie Azinge, SAN after leading the fourth subpoena witness in evidence and subsequent cross examination by Counsel to the respondents, informed the Court of the development
Labour Party had earlier listed 37 witnesses and 4 subpoena to testify in its case, but was able to present 30 witness and all 4 Subpoena.
The Court has adjourned to Tuesday, 18th July, 2023 for the first respondent, INEC to open its defence.
