The Abuja Federal High Court in Abuja has affirmed Victor Oye as the lawful and legitimate National Chairman of the All Progressives Grand Alliance, APGA.
Justice James Omotosho while delivering judgment in the suit brought before the court by APGA and Chekwas Okorie held that by the judgments of the Court of Appeal Kano division and later Supreme Court, it is clear that there is no evidence that the judgment has been set aside.
The court held that the Supreme Court only made the correction in the typographical error made when Njoku’s name was substituted with that of Oye, but upheld the decision of the lower court which maintained that Oye was the validly elected candidate.

APGA, Chekwas Okorie, and two others had approached the court to recognize them as the authentic faction of the party, having been produced by the Njoku Led National Working Committee.
The Court condemned the action of a legal practitioner, representing the plaintiffs CN Nwagwu, for misleading the Court and for causing unnecessary confusion that led to a waste of Judicial time.
Justice Omotoso, therefore, slammed a cost of 200 thousand Naira against the Njoku Led Faction while admonishing Nwagwu, for having failed to act as Minister in the temple of Justice.
The trial Judge also held that Edozie Njoku tried to deceive the general public by misinterpreting the decision of the apex court and the appellate court in Kano.
The respondents in the suits are the Independent National Electoral Commission, INEC, Umeadi Peter Nnanna, Timinini George, and Eze Kanayo.
