The Department of State Services, DSS, Tuesday moved an application before a Federal High Court sitting in Lagos, seeking to withdraw charges filed against suspended Governor of the Central Bank of Nigeria, Godwin Emefiele.
The Prosecution in its submission Tuesday before the court , said the decision to withdraw previous charges against Godwin Emefiele before the Lagos court, follows fresh application filed before a federal high court in Abuja, against the former governor of Nigeria’s apex court.
With the battle for the unlawful custody of embattled governor of the Central Bank of Nigeria, Godwin Emefiele still ongoing, events took a new twist at the resumed sitting, Tuesday, as the federal government moved an oral application for the withdrawal of the charges filed against Emefiele.
The DSS had on the 25th of July, 2023 re-arrested the former governor after he was arraigned and granted bail following charges of unlawful possession of firearms and ammunition brought against the former governor of Nigeria’s apex bank.

The Director of Public Prosecutions, at the federal ministry of Justice, Abubakar Mohammed, who moved for the application sighting section 108 of the adminstration of criminal justice act, 2015 says the move for the withdrawal of charges is due to emerging facts requiring further investigation.
Mohammed who said the Prosecution is not in disobedience of any lawful court order, however disclosed that there are pending fresh charges at the Federal High Court, Abuja against the defendant.
Defense counsel for the defendant, Joseph Daudu SAN, in submissions, noted that the court had earlier granted the defendant bail which he noted has been grossly violated by the prosecution, arguing that order has to be obeyed first before any fresh applications can be taken from the prosecution.
Justice Nicholas Oweibo thereafter adjourned the case to the seventeenth of August, twenty-two and three, for ruling.
