NLC, TUC, PSI, ITUC, WABBA COMMEND ICJ ON WORKERS RIGHT TO STRIKE
The International court of Justice in the Hague has confirmed the right to strike of workers and Trade unions.
In an unprecedented advisory opinion delivered today the court affirmed that the right of workers and their organisation to strike is protected under the Freedom of Association and protection of the right to organise in ILO convention Number 87 of 1948.
In their various reactions to the judgement, a former global president of the international trade unions confederation, Ayuba Wabba and the current African region general secretary, of ITUC-Africa, Akhator Joel Said the ruling speaks to the truth about workers agitations for better welfare and rights upholding, but warn against abuse of the instrument
Also, the public services international global headquatres and the industriall global unions have continue to score
the advisory by the ICJ high, noting that the careless anti-labour antics of some employees, will be put to check.
The ILO’s employer group challenged the right to strike workers and the case was brought to the ICJ by the ILO itself. And, on November 10, 2023, the ILO Governing Body formally requested an advisory opinion from the ICJ.

This came after a decade-long dispute inside the ILO between employers and workers over whether th3 ILO Convention Number 87 on Freedom of Association protects the right to strike.
The ICJ held hearings in 2025 and delivered its advisory opinion on 22 July 2025, before the judgment on june 22, 2026, confirming that the right to strike is protected under Convention Number 87.
