The Nigerian Bar Association, NBA, has raised concerns over what it describes as increasing judicial interference in the internal affairs of political parties, warning that such actions could undermine Nigeria’s democracy ahead of the 2027 general elections.
In a statement, the NBA said recent legal and political developments linked to the Electoral Act 2026 have exposed worrying trends, particularly the involvement of courts and lawyers in intra-party disputes.
The association cited Section 83 of the Act, which bars courts from entertaining cases relating to the internal affairs of political parties, including the granting of interim or interlocutory injunctions in such matters.
According to the NBA, despite these provisions, some lawyers continue to file suits in violation of the law, while courts have allegedly issued orders that contradict the statute.
The body warned that such practices could lead to abuse of court processes, forum shopping, and manipulation of the judicial system for political advantage.
It stressed that lawyers must uphold their professional responsibilities, cautioning that those who engage in actions aimed at drawing courts into political party disputes risk disciplinary action before the Legal Practitioners Disciplinary Committee.
The NBA also called on the National Judicial Council, NJC, to sanction any judge found to have assumed jurisdiction in matters clearly barred by law or issued orders in violation of statutory provisions.
The association further urged the Independent National Electoral Commission, INEC to exercise its powers with neutrality and independence, warning against any actions that could weaken public confidence in the electoral process.
Reaffirming its commitment to protecting the rule of law, the NBA said it would deploy all lawful mechanisms to prevent abuse of the legal system and ensure that the judiciary is not used for political manipulation.
