Niger State Govt drags AEDC to court over unpaid N468.2m tax

The Niger State Internal Revenue Service, (NGSIRS), has dragged the Abuja Electricity Distribution Company, (AEDC), before a Minna High Court, demanding the payment of four hundred and sixty-eight million, two hundred twelve thousand, nine hundred and eighty-nine Naira.

The money, being tax liability, due and outstanding, in respect of the statutory tax audit, payee, without tax, business premises registration, and renewal fee, environment fee, development levy, and ground rents, due for the defendant, from the periods of 2019–2022, and 2017–2023, respectively.

According to the originating process filed in court, the plaintiff’s claim against the defendant is for a declaration that the plaintiff, being an agency of the Niger State government, is saddled with the statutory objective of administering, controlling, and consolidating the various taxes and non-tax revenues, and to account for all such taxes and non-tax revenues, and to account for all such revenue collected.

Equally, the plaintiff demanded the court to order the defendant to account for all such taxes and non-tax revenues collected in Niger State.

In a suit number, NSHC/MN/58/2024, filed at Minna High Court number three by a Minna-based legal practitioner, Mohammed Ndayako SAN, the court sought an order directing the defendant to pay the plaintiff interest on the judgement sum, at the rate of ten percent per annum, until the same is fully liquidated.

Ndayako also demanded that the defendant pay the plaintiff the cost of ”this litigation as may be assessed by this honourable court.”

When the case came up for mention on Tuesday, the counsel for the defendant was not in court, just as the court was told that they were not served with hearing notice, that the case was slated for mention on Tuesday.

The originating process was, however, served on them, informing the counsel for the defendant that the case has been adjourned to May 27 for further mention.

The judge, Justice Marya Ismail, then adjourned the case to May 27, for further mention, with an order for the service of originating process on the defendant.
