A Federal High Court sitting in Lagos has fixed the 18th of October, 2023 for the arraignment of Senator Ifeanyi Ubah.
The court also directed that criminal summons be issued on Senator Ubah and his company, Capital Oil and Gas Limited.
Prosecution counsel led by Tunde Lawal had prayed the court to issue a bench warrant against the defendant whom he said was not in court during the last adjourned date.
The defense counsel , Ifeoma Esom told the court that the matter was for report of settlement adding that they were just informed that the settlement had failed because of the absence of the first defendant.
Lawal on his part argued that the court being a criminal court couldn’t make settlement part of its business adding that though the parties may choose to settle outside the court it does not give the first defendant the right to be absent from the proceedings.

In his ruling, Justice Nicholas Oweibo ordered that summons be served on the first defendant adding that if Senator Ubah fails to show up on the next adjourned date, a warrant for his arrest will be issued.
The Federal government commenced criminal prosecution against Senator Ifeanyi Ubah in 2019 in an eight-count charge on account of his indebtedness to the Asset Management Corporation of Nigeria.
Justice Oweibo then adjourned the case to the 18th of October, 2023.
