Supreme Court fixes October 24 to hear appeal against discharge of Nnamdi Kanu

The Supreme Court has fixed Monday, October 24, for hearing of the Notice of Appeal filed by the Federal Government challenging the Court of Appeal judgement, that quashed terrorism charges against detained leader of the Indigenous people of Biafra, IPOB, Nnamdi Kanu.

This was mentioned in a statement issued by Kanu’s lawyer, Ifeanyi Ejiofor after visiting the IPOB leader at the Department of State Services, DSS detention facility, to brief his client on recent developments.

Ejiofor mentioned that although the appeal is a constitutional right of the Federal Government, they must first obey the order of the Court of Appeal directing the immediate and unconditional release of Kanu.

According to Ejiofor, the Federal Government has been in contempt of the positive orders the appellate court made since October 13, 2022 which prohibit any further detention of Kanu and subjecting him to any further trial.

The Federal Government had filed an appeal asking the Apex Court to stay execution of the appellate court’s judgement delivered on October 13, 2022.

The Federal Government in its Notice of Appeal faulted the decision of the Court of Appeal, and also prayed the apex court to set it aside.

In a judgement read by Justice Oludotun Adefokpe-Okojie, of the three-man panel lead by Justice Jummai Hannatu, the appellate court slammed the Nigerian Government for the manner in which Kanu was extradicted from Kenya, saying it was a clear breach of international law and procedure.
