Kano Emirate Tussle: Abuja Court Fixes August 12 To Hear State’s High Court Pending Appeals

The court of appeal in Abuja has fixed August 12 to hear all the four pending appeals emanating from decisions of the Federal High Court, Kano and Kano State high court on the state’s emirate tussle.

Justice Hamma Akawu- Barka who led the three man panel gave the date after the case was mentioned and the appellant counsel Chikamso Ojukwu in an oral application sought to remove one of the respondents name .

The application was opposed by the defence counsel, Mahmoud Mogaji and the court directed that application be filed .

The pending appeals are filed by the Kano State government and the attorney general, Kano State House of Assembly and the Speaker as well as an interlocutory appeal filed by Emir Aminu Ado Bayero

The appellants are challenging the decision of Justice Abdullahi Liman, who set aside steps taken in pursuance of the Kano Emirates Council Law (repeal) 2024 and ordered parties to maintain “status quo ante” pending hearing and determination of a suit filed by Aminu Babba Dan-agundi ,Sarkin Dawaki.

The appellant said he want the court of appeal to revert the order of the Kano high court, he alleged that the judgement was entered in a hurry on 15 th of July instead of 18th as stipulated.

The Assembly had on May 23 passed the bill which was assented by Governor Abba Yusuf which deposed the five emirs of Kano, Bichi, Rano, Karaye and Gaya Emirates.

The governor then reinstated Muhammadu Sanusi II as Emir of Kano.

Following a restraining order granted by the Federal High Court, Emir Ado Bayero returned to Kano and occupied Nasarawa mini palace where he has been holding court, prompting the state government to order for his eviction.
