The African Action Congress (AAC) has filed a suit at the Federal High Court in Abuja challenging President Bola Tinubu’s alleged failure to transmit a written declaration to the National Assembly during his extended vacation outside Nigeria.
The suit, filed on September 28, 2026, by AAC National Legal Adviser Inibehe Effiong, names President Tinubu, Attorney-General of the Federation Lateef Fagbemi, Senate President Godswill Akpabio, House Speaker Tajudeen Abbas and the National Assembly as defendants.
The party is asking the court to interpret Section 145 of the 1999 Constitution and determine whether the President was required to transmit a written declaration to the Senate President and Speaker of the House of Representatives to enable Vice-President Kashim Shettima to act as President.
AAC is also challenging the National Assembly’s alleged failure to pass a resolution authorising Shettima to act after the President’s absence exceeded 21 days.
The party is further seeking an order requiring future presidents to comply with the constitutional provisions before proceeding on vacation.
No hearing date has been fixed for the case.
