The Federal High Court in Abuja has refused to order the Federal Government to release the detained Deputy Commissioner of Police, DCP Abba Kyari from the custody of the National Drug Law Enforcement Agency, NDLEA on drug-related allegations.

This was the outcome as the suspended DCP Kyari dragged the Federal Government before the court challenging his continued detention by the agency of government. In the suit, Kyari sought an order of court to immediately release him on health grounds.

However, when the case was called up, Justice Inyang Ekwo, noted that the suit contained some allegations that would require Federal Government’s response.

Kyari’s counsel, Cynthia Obianuju, claimed her client is suffering from life threatening medical conditions and needs urgent attention.

Justice Ekwo in his brief ruling declined to order his immediate release but ordered the plaintiffs to put the respondent on notice and serve them with processes filed.

Justice Ekwo held that the allegations made against the Federal Government are weighty and that the court must give it the opportunity to be heard before taking any step.

He then fixed February 24 for the parties to appear before him.
