Extradition Suite : Court allows Abba Kyari issuance of more evidence against FG

A federal High court in Abuja on Thursday granted permission to the detained Deputy Commissioner of Police DCP, Abba Kyari to file more evidence against a suit by the federal government seeking to extradite him to United States of America for trial in alleged criminal charges.

Justice Inyang Ekwo granted the request Kyari made through his lead counsel Nureni Jimoh, SAN in a motion on notice, praying the court to allow Kyari bring additional documentary exhibits to establish his innocence in the charges against him.

The federal government counsel, Pius Akuta however opposed the granting of the request, on the ground that it was an attempt to cure deficiencies in the earlier documented evidence adduced by the detained DCP Kyari.

Justice Ekwo in a brief ruling granted permission to Kyari to adduce further documentary exhibits to his own defense, stating that the court would determine the probate value to be attached to the additional evidence.

Justice Ekwo however fixed June 3 for definite hearing in the suit.

Abba Kyari, a suspended deputy commissioner of police and former head to the Inspector-General of Police Intelligence Response Team (IRT), is to be handed over to the U.S government over allegations of wire fraud involving Abbas Ramon popularly known as Hushpuppi.

The Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami, filed an extradition application at the Federal High Court in Abuja following a request by the Diplomatic Representative of the U.S. Embassy in Abuja.

According to The AGF, the request from the U.S. authorities, is for the surrender of Abba Alhaji Kyari, who is a suspect in a superseding three counts indictment.

Kyari is wanted to stand trial in the United States for conspiracy to commit wire fraud and money laundering, and identity theft.
