2022 Electoral Act: Court shifts PDP suit against Buhari, AGF to 19 January 2023

The hearing of the suit instituted by the Peoples Democratic Party, PDP, against President Mohammadu Buhari, challenging the move to tamper with the 2022 Electoral Act, has been fixed for January 19, 2023.

When the matter came up on Wednesday, counsel for the PDP, James Onoja, told the court that there has been a judgement delivered by the Supreme Court, in a suit filed by President Buhari and the Attorney General of the Federation, Abubakar Malami.

He urged the court to proceed with that of the PDP since the apex court did not delve into the substantive matter, as it only struck out Buhari’s suit, for lack of jurisdiction.

But counsel for the defendant drew the attention of the court, to a sister case at the apex court, and urged it to wait for its decision.

In a ruling, Justice Nyang Ekwo, adjourned after noticing that there is an existing suit pending before the Supreme Court, that in the circumstance, the Federal High Court should hold its hearing, pending the report of the Supreme Court on the electoral act.

The PDP in the suit had sued President Buhari, the Attorney General of the Federation, and the Senate President, over their move to alter an aspect of the act, after it had been signed into law by the president.

Onoja on his part, argued that President Buhari lacks the power to alter or delete Section 84 of the Electoral Act, and has signed it into law.
