The magistrate court 2, sitting in Warri Delta state, has adjourned the suit instituted by the Delta state commissioner of police against former Ologbosere of Warri kingdom, Ayiri Emami, over the alleged missing crown of the Olu of Warri to June 1,2022.
The adjournment followed a botched attempt by the prosecuting counsel to argue for a stay of proceedings on an application brought before the court in the case which has been pending since last year.
At the resumed hearing, the lead counsel to the prosecutor, Abiodun Amuda, SAN cited section 304 of the administration of criminal justice ACT, 2017, while praying for stay of proceedings of the matter by the court, a motion which was vehemently opposed by the lead counsel to the defendant, Victor Otomiemo, SAN, describing the interlocutory application as incompetent.
After listening to arguments from the defendant and prosecutor, Justice Ejiro Diejomoa, adjourned the case to June 1,2022 for ruling on the application for stay of proceedings.
