Benue: High Court Strikes Out Case Against APC State Chairman

A high court sitting in Benue has struck out the case filed against the Chairman of the All Progressive Congress (APC), Benue State chapter, Austin Agada.

The State APC Legal Adviser Matthew Alyebo urged the Makurdi High Court to strike out two suites, MHC/04/2024 Moses Agaba v. Augustine Agada and APC, and  MHC/62/2024 Benjamin Omakolo v. APC.

The motion was grounded on the basis of want of diligence in pursuing the cases on the part of the appellants. 

During proceedings it was noted that JJ Usman representing the plaintiffs was absent from the courtroom without any prior correspondence explaining his absence.

Consequently the Presiding Judge Polycarp Kwahar concurred with the APC Counsel’s argument, that the plaintiffs had sufficiently abandoned their cases due to their lack of diligence.

Both cases were promptly struck out, marking a significant victory for the Benue State APC and its legal representation. 

Recall that Moses Agaba and Benjamin Omakolo had in separate suits dragged Austin Agada to court challenging his legitimacy as Chairman of the APC in Benue State.

Subsequently Agaba later secured an interim injunction restraining Agada from parading himself as Chairman which was later vacated by a Benue State High Court sitting in Makurdi on the 12th February 2024.
