Court dismisses suit by dethroned Emir of Maru Ibrahim Abubakar against IGP, 5 others

The suit filed by the dethroned Emir of Maru, Ibrahim Abubakar, against the Inspector General of Police and five others, challenging his unlawful detention, infringement of fundamental human rights and demanding N6.5 billion damages has been dismissed.

The presiding judge, Justice Bello Shinkafi, dismissed the case because the law enforcement agencies acted within the ambit of the law, leading to the deposed emir’s detention at the Government House for eleven months.

The judge noted that the action of the police and the operatives of the Department of State Services, DSS who are respondents in the suit, did not violate the applicant’s fundamental human rights.

The counsel to the six respondents, who is the former Secretary to the Zamfara State Government, Bala Maru, described the judgement as good, considering the prevailing insecurity in the state.

The Lead counsel to the applicant, Sam Anosike said, his team will study the judgement and may appeal.

He insisted that the judgement left out germane issues in the application, particularly that of the infringement of his client fundamental human rights, unlawful detention and character defamation.

Anosike noted that the allegations against the dethroned emir on the insecurity bedevilling Zamfara State could not be established, but that the court claimed the actions of the security agencies were within the confines of the law.
