Court grants Kanu permission for order compelling DSS to allow access to medical care

A Federal High Court in Abuja has granted the detained leader of the Indigenous People of Biafra, IPOB, Nnamdi Kanu, the permission to apply for an Order If Mandamus, to compel the Department of State Service, DSS, to grant him access to his doctors.

The trial judge, Justice Binta Nyako, gave the order after she heard an Exparte Application, filed by Kanu’s lead counsel, Mike Ozekhome.

Kanu had instituted a fresh suit to compel the DSS, to grant him unhindered access to his doctors, to enable them to conduct an independent examination to ascertain his state of health.

He is also asking the court for an order granting leave to apply for judicial review, in the form of an Order of Mandamus, compelling the Respondents to avail Kanu with all his medical records, from the 29th day of June 2021, till date.

Kanu had alleged that all medical experts that have so far attended to him, had failed to medically fathom the explanation for the continued failure of various treatments, so far given to him.

He added that the medical personnel that attended to him while in custody had repeatedly informed him, that they could not ascertain the reason for the depletion of potassium in his blood.

The court adjourned the case till February 21, even as it ordered Kanu, to serve the process on the DSS.
