Supreme court reserves ruling on Zamfara election judgement review

ZAMFARA ELECTION

The Supreme Court has reserved ruling in the request made by the All Progressives Congress, APC and the immediate-past Governor of Zamfara State, Abdul-Azeez Yari asking for review of its judgment that was delivered on May 24, 2019.

The panel of justices led by the Chief Justice of Nigeria, Justice Tanko Muhammad reserved ruling saying a date will be communicated.

When the matter came up on Tuesday, Counsel for APC and Yari, Robert Clark prayed the court to set aside its decision.

Counsel for Kabiru Marafa-led faction, Mike Ozekhome in his argument said the application violates Sections 275 and 235 of the Nigerian Constitution.

Ozekhome argued that on 17th of June, 2019, there was a similar application thus in the light of this the application amounts to gross abuse of court process.

And there were two most recent decisions of the court delivered in February 2020 as a hint for the applicant to withdraw his case.

After the argument the 5-member panel of Justices headed by the CJN, Justice Tanko Muhammad, court therefore reserved ruling to a date to be communicated to the parties.

The applicants are challenging the Supreme Court judgement in Zamfara State on the basis of its consequential orders that handed victory to candidates of the Peoples Democratic Party, PDP, in the State.

They also contended that the reliefs the Supreme Court granted in favour of the PDP and its candidates, were extraneous to issues that aggrieved members of the APC brought before it for adjudication.
