United States District Court for the District of Columbia has rejected a request by Aaron Greenspan seeking permission to obtain evidence from President Bola Tinubu and DCI Group in an ongoing Freedom of Information Act, FOIA litigation involving the Federal Bureau of Investigation, FBI and the Drug Enforcement Administration, DEA.

The development was made public by President Tinubu’s Special Adviser on Information and Strategy, Bayo Onanuga, in a post on his X account, sharing details of the October 30 court ruling.

According to the information posted by Onanuga, the court ruled that the proposed discovery relating to alleged cyberattacks on Greenspan’s website was not sufficiently relevant to the underlying FOIA dispute involving the FBI and DEA.

The court also rejected a separate application by Karl Von Batten to file an amicus curiae brief, as well as Greenspan’s request for judicial notice. It equally denied the plaintiff’s motion for summary judgement.

Reacting to the ruling, attorney Christopher Carmichael said the decision reinforces the need to keep the litigation focused on the legal issues properly before the court.

Another attorney, Oluwole Afolabi, described the decisions as establishing important procedural boundaries in the ongoing proceedings.

The ruling, however, does not amount to a final determination of the underlying FOIA dispute, which remains before the court.
