A federal high court in Abuja has fixed March 9 for the hearing of a suit against President Muhammadu Buhari over his refusal to transmit a written declaration to the Senate and House of Representatives when proceeding on vacation.
The plaintiff, Vincent Adodo, wants the court to declare as unlawful and unconstitutional for the president to proceed to any medical vacation or tourism without transmitting a written declaration to the Senate and house of representatives as mandatorily required by section 145.

Adodo is also praying to the court for an injunction restraining him from seeking medical treatment abroad in violation of section 46 of the National Health Act 2014 except for exceptional cases which will be approved by the Ministry of health.
The president, vice president, and the Attorney General of the federation had filed and served their counter affidavit before the court and to the plaintiff.
Going by the delay by the ministry of health in serving the plaintiff with its process, the court held that the matter was not ripe for hearing and adjourned the case to March 9 for hearing.
