The panel of 3 justices led by Justice Kashim Kaigama has declared Yahaya Bello of the All Progressives Congress, APC as the duly elected governor of Kogi State in the November 16, 2019 governorship election in the state.
In a split judgement of 2 to 1, the tribunal in the majority ruling held that the petition lacks merit and could not stand.
Justice Ohimai Ovbiagele, however, in a descenting judgement upturned the election saying the evidence of the forensic expert is uncomplicated and credible.

He said the video evidence shown also corroborated the evidence of the petitioner, Musa Wada of the People’s Democratic Party, PDP. He, therefore, nullified the election and ordered fresh polls within 3 months.
