Justice Peter Affen has reserved Judgement in a suit filed by the publisher of Power Steering Newspaper, a monthly magazine that covers the power sector, Tom Uhia.
The publisher had taken the Minister of State for Power, Goddy Jedy-Agba, Michael Anthony Ogbizi of the Force Criminal and Intelligent Investigation Department, FCIID, Abuja; ACP Tahir Usman; ACP Gabriel Elaigwu;/Rogas Elijah Ilebel and the Nigerian Police Force before the federal high court, Abuja for the enforcement of his fundamental rights.
The claimant in an origination summons, dated October 20, 2020, sought a declaration of the court that his detention at the FCID by the respondents from October 13 to 15, 2020 and his continued detention since October 16, 2020, after the fulfillment of bail conditions till date without being arraigned before a court was unlawful and unconstitutional.
He further sought, among others, a declaration that searching his house at Gwarimpa, Abuja, on October 14, 2020, by the respondents at the instance of the first respondent was in derogation of his right to privacy guaranteed by Section 37 of the Constitution.

Uhia was first arraigned by the police before Justice Abdul Mohammed of the High Court of FCT and was granted bail.
